RELIABLE RESIDENCE - TERMS OF SERVICE FOR HOSTS

These Terms of Service ("Terms") constitute a legally binding agreement between
the undersigned Host ("Host", "Owner", or "you") and Reliable Residence Inc., a
Wisconsin C corporation ("Marketplace," "we," "our," or "us"), governing your
use of our platform and related services ("Marketplace Services") to list and
rent short-term rental properties to healthcare professionals ("Renters").
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE MARKETPLACE SERVICES.
1. ABOUT RELIABLE RESIDENCE
1.1 Marketplace Services Overview
Reliable Residence operates an online marketplace connecting property owners
with healthcare professionals seeking furnished monthly housing. We are a
marketplace platform, not a property manager, landlord, or party to any rental
agreement between Hosts and Renters.
1.2 Marketplace Role
Reliable Residence provides:
• A platform for Hosts to list furnished properties
• Renter screening services on behalf of Hosts
• Payment processing through Stripe
• Booking coordination and customer support
We do NOT:
• Manage your property or handle maintenance
• Act as a party to rental agreements between Hosts and Renters
• Control the day-to-day operations of your property
• Provide property management services (lawn care, snow removal, repairs, etc.)
• Guarantee bookings or occupancy rates
2. ELIGIBILITY & ACCOUNT CREATION
2.1 Eligibility Requirements
To list properties on the Marketplace Services, you must:
• Be at least 18 years of age
• Have legal authority to rent the property (owner or authorized agent)
• Provide accurate and complete information
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Marketplace Services under applicable law
• Comply with all applicable federal, state, and local laws, including landlord-
tenant laws, zoning regulations, and tax obligations
2.2 Account Registration
You agree to:
• Provide truthful, accurate, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account
2.3 Account Suspension or Termination
We reserve the right to suspend or terminate your account at any time for:
• Violation of these Terms
• Fraudulent or deceptive conduct
• Property listings that violate our standards or policies
• Failure to pass property verification
• Complaints or negative feedback from Renters
• Non-compliance with applicable laws
• Any conduct that we determine, in our sole discretion, harms or could harm
Reliable Residence, Renters, or other users
3. PROPERTY LISTING REQUIREMENTS
3.1 Minimum Property Standards
All properties listed on the Marketplace Services must meet the following
requirements:
REQUIRED:
• Fully furnished (including all furniture necessary for comfortable living)
• Linens and towels included
• All utilities included in rent (electric, gas, water, sewer, trash)
• WiFi internet included in rent
• Pass in-person walkthrough and verification by Reliable Residence
PROHIBITED:
• Properties that do not meet local health and safety codes
• Properties with active code violations
• Properties in violation of HOA rules or lease restrictions (if applicable)
• Properties used for illegal purposes
3.2 Property Verification & Walkthrough
Before your property can accept bookings:
• You must complete your listing with accurate information and photos
• A Reliable Residence representative will conduct an in-person walkthrough
• We will verify that the property meets all minimum standards
• We will make the final approval decision based on our thorough review of the
walkthrough
You acknowledge and agree that:
• Property approval is at Reliable Residence's sole discretion
• We may deny any property for any reason, including subjective factors such as
cleanliness, condition, location, or marketability
• Approval does not constitute any guarantee, warranty, or representation about
the property's condition or suitability
• We may remove or suspend your listing at any time if standards are not
maintained
3.3 Accurate Listing Information
You represent and warrant that:
• All information in your listing is accurate, complete, and not misleading
• Photos accurately represent the current condition of the property
• You have disclosed all material defects or issues with the property
• You have legal authority to rent the property
• The property complies with all applicable laws and regulations
3.4 Listing Updates
You agree to:
• Keep your listing information current and accurate
• Update availability calendars promptly
• Notify us immediately of any material changes to the property
• Remove or update photos if the property condition changes
4. BOOKING TYPES & RENTER SCREENING
4.1 Booking Type Selection
When creating your listing, you will select one of two booking types:
INSTANT BOOK:
• Renters can book immediately without your prior approval
• Bookings are automatically confirmed
REQUEST TO BOOK:
• Renters submit booking requests for your review
• You have 24 hours to approve or decline
4.2 Renter Screening Options
You will select one of two screening approaches:
OPTION A: Reliable Residence Screens Renters
• Reliable Residence conducts comprehensive background and credit screening
• Screening includes criminal background, credit history, eviction records, tax
liens, and sex offender registry
• Screening results are valid for 12 months
• You receive screening results (approved or denied) but not underlying report
details
• No cost to you
OPTION B: You Screen Renters Yourself
• You handle all screening using your own criteria and processes
• You are solely responsible for compliance with fair housing laws and screening
regulations
• You must conduct screening within 24 hours of receiving a booking request
4.3 Fair Housing Compliance
Regardless of which screening option you choose, you agree to:
• Comply with all federal, state, and local fair housing laws
• Not discriminate based on race, color, religion, national origin, sex,
familial status, disability, or other protected classes
• Apply screening criteria consistently to all applicants
• Maintain records documenting your screening decisions
5. BOOKINGS & RENTAL AGREEMENTS
5.1 Minimum Stay Requirement
All bookings must be for a minimum of 30 consecutive nights. Reliable Residence
specializes in monthly rentals for healthcare professionals and does not
facilitate short-term vacation rentals.
5.2 Booking Agreement
When a Renter books your property, both you and the Renter will check a box
indicating agreement to a Booking Agreement that includes:
• The rental period (check-in and check-out dates)
• Total rent amount and payment schedule
• Your specific property rules and requirements
• Cancellation and refund policies
• Renter's obligations
This Booking Agreement is a direct contract between you and the Renter. Reliable
Residence is not a party to this agreement.
5.3 Your Responsibilities as Landlord
You are solely responsible for:
• Property condition, safety, and habitability
• Compliance with all applicable landlord-tenant laws
• Property maintenance and repairs during the rental period
• Security deposits (if you choose to collect them)
• Lease enforcement
• Eviction proceedings (if necessary)
• Property insurance
• Payment of all property-related taxes and fees
5.4 Security Deposits
If you choose to collect security deposits:
• Security deposits are processed through Stripe on your behalf
• You set the security deposit amount
• You set the refund timeline and conditions
• You must comply with all state and local security deposit laws regarding
amounts, holding periods, interest, itemized deductions, and refund timelines
• Security deposit disputes are between you and the Renter
• Reliable Residence is not involved in security deposit disputes or
determinations of refund amounts
5.5 Property Access & Check-In
You are responsible for:
• Providing Renters with access to the property on the check-in date
• Ensuring the property is clean and ready for occupancy
• Providing any keys, codes, or access instructions
• Being available or designating a representative for check-in coordination
6. PAYMENT TERMS
6.1 Payment Processing
All payments are processed through Stripe, a third-party payment processor. By
using the Marketplace Services, you agree to:
• Create and maintain a valid Stripe account
• Stripe's Terms of Service and Privacy Policy
• Provide accurate banking information for payouts
6.2 Service Fee
Reliable Residence charges Hosts a service fee of 3% of the total booking amount
(including rent and any additional fees you charge). This service fee:
• Covers platform usage, Renter screening (if applicable), customer support, and
payment processing
• Is calculated as 3% of (base rent + any Host fees such as cleaning fees, pet
fees, etc.)
• Is automatically deducted from payments before payout to you
• Is non-refundable except as provided in Section 7 (Cancellations)
Additionally, Renters pay a separate 5% service fee on their end.
Example calculation:
• Monthly rent: $2,000
• Your cleaning fee: $100
• Subtotal: $2,100
• Reliable Residence service fee to you (3%): $63
• Amount you receive: $2,037
• Renter pays separately: $2,100 + $105 (5% Renter fee) = $2,205 total to Renter
6.3 Payout Schedule Options
You will select one of two payout schedules:
LEASE-ALIGNED RENT:
• Rent period runs from a specific day of the month to the day before that same
day the next month (e.g., 14th to 13th)
• First period runs from booking start date to the day before that same date the
next month
• Subsequent periods continue on the same schedule
• Last period is prorated if booking ends before the scheduled end date
• Example: Booking from June 14 - September 10
→ June 14 - July 13: Full month
→ July 14 - August 13: Full month
→ August 14 - September 13: Full month
→ September 10 end date: Prorated (3 days early, so deduct 3 days from final
month)
CALENDAR-ALIGNED RENT:
• Rent runs from 1st of month to end of month
• First month prorated from booking start date to end of that month
• Last month prorated from 1st to booking end date (if doesn't end on last day
of month)
• Example: Booking from June 14 - September 10
→ June 14-30: Prorated
→ July 1-31: Full month
→ August 1-31: Full month
→ September 1-10: Prorated
6.4 Payout Timing
Payments are transferred to your Stripe account according to your selected
payout schedule. Stripe then transfers funds to your bank account according to
your Stripe payout settings (typically 2-5 business days).
7. CANCELLATIONS & REFUNDS
Cancellation and refund policies are established between you and the Renter and
must comply with all applicable federal, state, and local laws. You are solely
responsible for:
• Setting and clearly communicating your cancellation policy
• Processing refunds according to your stated policy and applicable law
• Complying with state-specific landlord-tenant laws regarding lease
terminations and refunds
• Handling all cancellation disputes directly with Renters
Reliable Residence is not a party to cancellation or refund determinations and
does not mediate cancellation disputes between Hosts and Renters.
8. HOST RESPONSIBILITIES & OBLIGATIONS
8.1 Property Maintenance
You agree to:
• Maintain the property in safe, habitable condition throughout all rental
periods
• Make necessary repairs promptly
• Respond to Renter maintenance requests within 24 hours
• Comply with all applicable building codes, health codes, and safety
regulations
• Maintain working smoke detectors, carbon monoxide detectors, and other
required safety equipment
8.2 Legal Compliance
You agree to comply with all applicable laws, including but not limited to:
• Federal, state, and local landlord-tenant laws
• Fair housing laws
• Zoning and short-term rental regulations
• Building and safety codes
• Tax obligations (income tax, occupancy tax, sales tax, etc.)
• HOA rules or lease restrictions (if applicable)
8.3 Insurance
You are solely responsible for maintaining adequate property insurance,
including:
• Property/hazard insurance
• Liability insurance
• Any additional coverage required by your mortgage lender or HOA
Reliable Residence does not provide any insurance coverage for your property.
8.4 Taxes
You are solely responsible for:
• Reporting rental income to appropriate tax authorities
• Paying all applicable income taxes
• Collecting and remitting any occupancy taxes, sales taxes, or other taxes
required by your jurisdiction
• Maintaining records for tax purposes
Reliable Residence does not withhold taxes from your payouts. You will receive a
Form 1099-K from Stripe if your annual payments exceed the IRS reporting
threshold.
8.5 Communication
You agree to:
• Respond to Renter inquiries within 24 hours
• Respond to Reliable Residence communications promptly
• Maintain professional and respectful communication
• Provide accurate information to Renters and Reliable Residence
9. LISTING REMOVAL & SUSPENSION
9.1 Our Right to Remove Listings
We reserve the right to remove, suspend, or delist your property at any time
for:
• Violation of these Terms
• Failure to maintain property standards
• Renter complaints regarding property condition, safety, or cleanliness
• Non-compliance with applicable laws
• False or misleading listing information
• Failure to respond to Renters or Reliable Residence
• Any conduct that we determine harms or could harm Renters, Reliable Residence,
or our reputation
9.2 Notice
We will attempt to provide you with notice before removing your listing, except
in cases involving:
• Immediate safety concerns
• Legal violations
• Fraudulent conduct
• Urgent situations requiring immediate action
9.3 Reinstatement
If your listing is removed or suspended, you may request reinstatement by:
• Correcting the violation or issue
• Providing documentation of corrective action
• Submitting a reinstatement request to contact@reliableresidence.com
Reinstatement is at our sole discretion and not guaranteed.
10. OPTIONAL FEATURES
10.1 Calendar Synchronization
You may optionally sync your Reliable Residence calendar with other platforms
(such as Airbnb) to avoid double-bookings. Calendar sync is:
• Entirely optional
• Your responsibility to set up and maintain
• Not guaranteed to be error-free
• Not a substitute for manually managing your calendar
You remain responsible for avoiding double-bookings and honoring all confirmed
reservations.
10.2 Additional Services
From time to time, we may offer additional optional services such as:
• Professional photography
• Property listing optimization
• Enhanced visibility or promotion
These services, if offered, will have separate terms and pricing.
11. PRIVACY & DATA USAGE
11.1 Data Sharing
We may share your information with:
• Renters (for booking purposes)
• Stripe (for payment processing)
• Service providers assisting with Marketplace Services operations
• Law enforcement or government agencies when required by law
11.2 Data Retention
We retain your personal information:
• Account information: Until you close your account plus 7 years for legal
compliance
• Booking information: 7 years after booking completion for legal and tax
purposes
• Payment information: According to Stripe's data retention policies
12. LIMITATION OF LIABILITY
12.1 Marketplace Services "As Is"
THE MARKETPLACE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-
INFRINGEMENT.
12.2 No Guarantee of Bookings
RELIABLE RESIDENCE DOES NOT GUARANTEE:
• Any specific number of bookings or occupancy rate
• That Renters will honor their bookings
• That your property will generate any particular income
• The conduct or identity of Renters
• That the Marketplace Services will meet your expectations
12.3 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RELIABLE RESIDENCE SHALL NOT BE LIABLE
FOR:
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Property damage caused by Renters
• Personal injury occurring at your property
• Disputes between Hosts and Renters
• Actions or omissions of Renters or other third parties
• Tax liabilities arising from your rental income
IN NO EVENT SHALL RELIABLE RESIDENCE'S TOTAL LIABILITY TO YOU EXCEED THE TOTAL
AMOUNT OF SERVICE FEES YOU PAID TO RELIABLE RESIDENCE IN THE 12 MONTHS PRECEDING
THE CLAIM.
12.4 Indemnification
You agree to indemnify, defend, and hold harmless Reliable Residence, its
officers, directors, employees, and agents from any claims, damages, losses,
liabilities, and expenses (including reasonable attorneys' fees) arising from:
• Your use of the Marketplace Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws
• Condition of your property or injuries occurring at your property
• Your relationship with Renters
• Your failure to pay taxes or comply with tax obligations
13. DISPUTE RESOLUTION
13.1 Informal Resolution
Before filing any formal claim, you agree to contact us at
contact@reliableresidence.com to attempt to resolve the dispute informally. We
will attempt to resolve the dispute within 30 days.
13.2 Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard
to conflict of law principles.
13.3 Venue
Any legal action arising from these Terms must be brought in the state or
federal courts located in Wisconsin. You consent to the exclusive jurisdiction
and venue of these courts.
13.4 Arbitration Agreement
Any dispute, claim, or controversy arising from or relating to these Terms or
your use of the Marketplace Services shall be resolved through binding
arbitration administered by the American Arbitration Association (AAA) under its
Commercial Arbitration Rules.
ARBITRATION MEANS YOU WAIVE YOUR RIGHT TO A JURY TRIAL.
The arbitration will be conducted in Wisconsin unless the parties agree
otherwise. Each party will bear its own costs of arbitration.
13.5 Class Action Waiver
YOU AND RELIABLE RESIDENCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER
ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER
IN ANY CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.
13.6 Exceptions to Arbitration
Either party may bring a claim in small claims court if it qualifies.
Additionally, either party may seek injunctive relief in court to prevent actual
or threatened infringement of intellectual property rights.
14. GENERAL PROVISIONS
14.1 Entire Agreement
These Terms, together with any Booking Agreement you enter into, constitute the
entire agreement between you and Reliable Residence regarding use of the
Marketplace Services.
14.2 Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of
material changes by:
• Posting the updated Terms on the Marketplace Services
• Sending an email to the address associated with your account
• Displaying a notice on the Marketplace Services
Your continued use of the Marketplace Services after changes become effective
constitutes acceptance of the modified Terms.
14.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the
remaining provisions will remain in full force and effect.
14.4 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver
of that provision or any other provision.
14.5 Assignment
You may not assign or transfer these Terms or your account without our prior
written consent. We may assign these Terms without restriction.
14.6 Independent Contractor
You are an independent business owner. Nothing in these Terms creates an
employment, partnership, joint venture, or agency relationship between you and
Reliable Residence.

rentals. We are a marketplace platform, not a landlord, property manager, or
party to any rental agreement between Renters and property owners ("Hosts").
1.2 Marketplace Role
Reliable Residence provides:
• A platform for Hosts to list furnished properties
• Renter screening services on behalf of Hosts
• Payment processing through Stripe
• Booking coordination and customer support
We do NOT:
• Own, manage, or control any listed properties
• Act as a party to rental agreements between Renters and Hosts
• Provide property management services
• Guarantee the condition, safety, or suitability of any property
2. ELIGIBILITY & ACCOUNT CREATION
2.1 Eligibility Requirements
To use the Marketplace Services, you must:
• Be at least 18 years of age
• Provide accurate and complete information
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Marketplace Services under applicable law

You agree to:
• Provide truthful, accurate, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential

• Non-payment or payment disputes
• Any conduct that we determine, in our sole discretion, harms or could harm
Reliable Residence, Hosts, or other users
3. TENANT SCREENING
3.1 Screening Requirement
All Renters must pass Reliable Residence's tenant screening process before
booking any property on the Marketplace Services. Screening is conducted on
behalf of Hosts to verify Renter suitability.
3.2 Screening Fee
• Screening fee: $25.00 per application
• Fee is charged once you complete the screening application and consent forms
• Fee is NON-REFUNDABLE if you pass screening
• Fee is REFUNDED if you fail screening and are denied approval
• If you do not complete the screening process, you will not be charged
3.3 Screening Validity Period
• If you pass screening, your approval is valid for 12 months from the date of
approval
• You may book multiple properties during this 12-month period without
additional screening fees
• After 12 months, you must undergo screening again and pay a new $25 fee
3.4 Screening Process
Screening is conducted by RentPrep by Stessa, a third-party consumer reporting
agency. The screening includes:
• Criminal background check
• Credit report review
• Eviction history search
• Tax lien search
• Sex offender registry check
By submitting a screening application, you:
• Authorize Reliable Residence and RentPrep to obtain consumer reports about you
• Authorize Reliable Residence to share your screening results (approved or
denied) with Hosts for booking purposes, but not the underlying report details
• Certify that all information provided is true and accurate
• Understand that false information may result in denial and account termination
3.5 Screening Criteria
AUTOMATIC PERMANENT DENIALS (No Time Limit):
Reliable Residence will deny any applicant with a criminal history involving:
• Murder or attempted murder
• Manslaughter
• Sexual assault or offenses
• Child abuse or endangerment
• Kidnapping
• Human trafficking
• Arson
• Aggravated assault
• Felonies involving firearms
• Armed robbery
• Sex offender registry match
DENIALS FOR OFFENSES WITHIN LAST 7 YEARS:
• Non-violent drug felonies
• Simple burglary
• Vandalism or property damage felonies
• Shoplifting felonies
• DUI (except causing death or serious injury)
• Non-violent fraud
• Other isolated misdemeanors
CREDIT & FINANCIAL DENIALS:
• Active bankruptcy proceedings
• Two or more accounts 60+ days past due (within last 12 months)
• Unresolved landlord-tenant judgment (within last 3 years)
• Unresolved civil judgment exceeding $2,000
• Unresolved tax lien exceeding $5,000
IDENTITY & SAFETY DENIALS:
• Sex offender registry match
• Identity mismatch or fraud alert on credit report
FACTORS THAT WILL NOT RESULT IN AUTOMATIC DENIAL:
• Low credit score
• High credit utilization
• Old evictions (3+ years)
• Old criminal convictions (7+ years for non-permanent denial offenses)
• Medical debt
• Thin credit file or no credit history
• Student loan burden
3.6 Screening Decisions
• Screening decisions are made by Reliable Residence based on the criteria above
• Decisions are final and at our sole discretion
• We reserve the right to deny any applicant for reasons not listed if we
determine, in our judgment, that approval would pose a risk to Hosts or the
Marketplace Services
3.7 Reapplication After Denial
If you are denied approval:
• Your $25 screening fee will be refunded in full
• You may reapply at any time by submitting a new screening application
• Each new application requires a new $25 fee
• If you fail subsequent screenings, the fee will be refunded each time
3.8 Disputes Regarding Screening Results
If you believe your screening results contain inaccurate information:
• Contact RentPrep by Stessa directly to dispute the information
• RentPrep handles all disputes regarding the accuracy of consumer reports
• You have the right to obtain a free copy of your consumer report
• Reliable Residence does not control the content of consumer reports and cannot
modify them
3.9 Fair Credit Reporting Act (FCRA) Notice
Reliable Residence uses consumer reports obtained from RentPrep by Stessa for
tenant screening purposes. You have rights under the Fair Credit Reporting Act
(FCRA), including:
• The right to know if information in your consumer report has been used against
you
• The right to know what is in your consumer report
• The right to dispute incomplete or inaccurate information
• The right to obtain a free copy of your consumer report if you are denied
If you are denied based on information in a consumer report, you will receive:
• An Adverse Action Notice explaining the denial
• The name and contact information of the consumer reporting agency (RentPrep by
Stessa)
• A statement that the consumer reporting agency did not make the decision and
cannot explain it
• Your right to dispute the accuracy of information in the report
• Your right to a free copy of the report within 60 days
4. BOOKING PROCESS
4.1 Booking Eligibility
To book a property, you must:
• Have a valid Reliable Residence account
• Have passed tenant screening (or have valid screening from within the last 12
months)
• Provide a valid payment method
• Agree to the Host's specific property terms and conditions
4.2 Booking Types
Properties may offer one of two booking types:
INSTANT BOOK:
• Your booking is automatically confirmed upon submission (subject to screening
approval)
• Payment is only processed upon successfully passing the screening process
REQUEST TO BOOK:
• Your booking request is sent to the Host for review
• Host has 24 hours to approve or decline
• Payment is only processed upon Host approval
• If Host declines or does not respond within 24 hours, your request is
cancelled and no payment is charged
4.3 Minimum Stay Requirement
All bookings must be for a minimum of 30 consecutive nights. Reliable Residence
specializes in monthly rentals for healthcare professionals and does not
facilitate short-term vacation rentals. Payment is only processed upon
successfully passing the screening process outlined in Section 3.
4.4 Booking Agreement
When you complete a booking, you agree to a Booking Agreement that includes:
• The rental period (check-in and check-out dates)
• Total rent amount and payment schedule
• Host's specific property rules and requirements
• Cancellation and refund policies
• Your obligations as a Renter
Both you and the Host will check a box indicating your agreement to the Booking
Agreement. This agreement is a direct contract between you and the Host.
Reliable Residence is not a party to this agreement.
5. PAYMENT TERMS
5.1 Payment Processing
All payments are processed through Stripe, a third-party payment processor. By
using the Marketplace Services, you agree to Stripe's Terms of Service and
Privacy Policy.
5.2 Service Fee
Reliable Residence charges Renters a service fee of 5% of the total booking
amount (including rent and any additional fees charged by the Host). This
service fee:
• Covers platform usage, customer support, and screening services
• Is calculated as 5% of (base rent + Host fees)
• Is charged at the time of each payment
• Is non-refundable except as provided in Section 6 (Cancellations)
Example calculation:
• Monthly rent: $2,000
• Host cleaning fee: $100
• Subtotal: $2,100
• Reliable Residence service fee (5%): $105
• Total due: $2,205
5.3 Payment Schedule
Payment schedules are determined by the Host and specified in your Booking
Agreement. Common payment structures include:
• Full payment upfront
• First and last month upfront, monthly thereafter
• Monthly installments
You agree to pay all amounts when due according to the payment schedule in your
Booking Agreement.
5.4 Payment Authorization
By providing payment information, you authorize Reliable Residence to charge:
• Rent payments according to your Booking Agreement
• The 5% service fee on each payment
• Any additional fees specified in your Booking Agreement (cleaning fees, pet
fees, etc.)
• The $25 screening fee (if applicable)
5.5 Failed Payments
If a payment fails:
• You will be notified via email or SMS (whichever you opt into) and given 5
business days to provide alternative payment
• Reliable Residence does not charge late fees, but the property owner has the
right to assess late fees as specified in your Booking Agreement with the Host
• Failure to cure a payment default may result in booking cancellation and
eviction proceedings initiated by the Host
• Your Reliable Residence account may be suspended or terminated
5.6 Refunds
Refunds are processed according to the lease agreement with the property owner
and the cancellation policy in Section 6. Property owners must follow applicable
state guidelines regarding security deposit refunds. All refunds processed
through Reliable Residence are returned via the original payment method within
5-10 business days.
6. RENTER RESPONSIBILITIES
7.1 Property Care
You agree to:
• Treat the property with care and respect
• Use the property only for residential purposes
• Comply with all property rules specified by the Host
• Maintain the property in clean condition
• Report any damage or maintenance issues to the Host promptly
• Not engage in illegal activities on the property
• Not disturb neighbors or other residents
7.2 Compliance with Laws
You agree to comply with all applicable federal, state, and local laws,
ordinances, and regulations during your stay.
7.3 Accuracy of Information
You represent and warrant that all information provided to Reliable Residence
and Hosts is accurate, complete, and not misleading.
7.4 Communication
You agree to:
• Respond to communications from Reliable Residence and Hosts in a timely manner
• Use the Marketplace Services's messaging system for booking-related
communications
• Maintain professional and respectful communication
7. HOST-RENTER RELATIONSHIP
8.1 Direct Contractual Relationship
Your rental agreement is directly between you and the Host. Reliable Residence
is not a party to this agreement and has no responsibilities or liabilities
arising from the rental relationship.
8.2 Host Responsibilities
Hosts are solely responsible for:
• Property condition, safety, and suitability
• Compliance with applicable landlord-tenant laws
• Property maintenance and repairs
• Security deposits (if applicable)
• Lease terms and enforcement
• Eviction proceedings (if necessary)
8.3 Disputes with Hosts
Any disputes arising from your rental (including property condition, maintenance
issues, lease violations, damage claims, or eviction) are between you and the
Host. Reliable Residence may assist in facilitating communication but is not
responsible for resolving landlord-tenant disputes.
8.4 Security Deposits
Some Hosts may require security deposits. Security deposits are:
• Held and managed by the Host, not by Reliable Residence
• Subject to state and local landlord-tenant laws
• Refunded according to the terms in your Booking Agreement with the Host
Reliable Residence does not hold, manage, or arbitrate security deposit
disputes.
8. PRIVACY & DATA USAGE
9.1 Information Collection
Reliable Residence collects and processes personal information as described in
our Privacy Policy, available at www.reliableresidence.com/privacy.
9.2 Data Sharing
We may share your information with:
• Hosts (for booking and screening purposes)
• RentPrep by Stessa (for screening purposes)
• Stripe (for payment processing)
• Service providers assisting with Marketplace Services operations
• Law enforcement or government agencies when required by law
9.3 Data Retention
We retain your personal information:
• Account information: Until you close your account plus 7 years for legal
compliance
• Screening results: 12 months from screening date
• Booking information: 7 years after booking completion for legal and tax
purposes
9. LIMITATION OF LIABILITY
10.1 Marketplace Services "As Is"
THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-
INFRINGEMENT.
10.2 No Guarantee of Property Quality
RELIABLE RESIDENCE DOES NOT GUARANTEE:
• The accuracy of property listings
• The condition, safety, or suitability of any property
• The conduct or identity of Hosts
• That properties comply with applicable laws or building codes
• That bookings will be honored by Hosts
10.3 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RELIABLE RESIDENCE SHALL NOT BE LIABLE
FOR:
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Property damage or personal injury occurring at rental properties
• Disputes between Renters and Hosts
• Actions or omissions of Hosts or other third parties
IN NO EVENT SHALL RELIABLE RESIDENCE'S TOTAL LIABILITY TO YOU EXCEED THE TOTAL
AMOUNT YOU PAID TO RELIABLE RESIDENCE IN THE 12 MONTHS PRECEDING THE CLAIM.
10.4 Indemnification
You agree to indemnify, defend, and hold harmless Reliable Residence, its
officers, directors, employees, and agents from any claims, damages, losses,
liabilities, and expenses (including reasonable attorneys' fees) arising from:
• Your use of the Marketplace Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your conduct during any rental stay
10. DISPUTE RESOLUTION
11.1 Informal Resolution
Before filing any formal claim, you agree to contact us at
contact@reliableresidence.com to attempt to resolve the dispute informally. We
will attempt to resolve the dispute within 30 days.
11.2 Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard
to conflict of law principles.
11.3 Venue
Any legal action arising from these Terms must be brought in the state or
federal courts located in Wisconsin. You consent to the exclusive jurisdiction
and venue of these courts.
11.4 Arbitration Agreement
Any dispute, claim, or controversy arising from or relating to these Terms or
your use of the Marketplace Services shall be resolved through binding
arbitration administered by the American Arbitration Association (AAA) under its
Consumer Arbitration Rules.
ARBITRATION MEANS YOU WAIVE YOUR RIGHT TO A JURY TRIAL.
The arbitration will be conducted in Wisconsin unless the parties agree
otherwise. Each party will bear its own costs of arbitration except that
Reliable Residence will pay your filing fees if your claim is $10,000 or less.
11.5 Class Action Waiver
YOU AND RELIABLE RESIDENCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER
ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER
IN ANY CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.
11.6 Exceptions to Arbitration
Either party may bring a claim in small claims court if it qualifies.
Additionally, either party may seek injunctive relief in court to prevent actual
or threatened infringement of intellectual property rights.
11. GENERAL PROVISIONS
12.1 Entire Agreement
These Terms, together with our Privacy Policy and any Booking Agreement you
enter into, constitute the entire agreement between you and Reliable Residence
regarding use of the Marketplace Services.
12.2 Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of
material changes by:
• Posting the updated Terms on the Marketplace Services
• Sending an email to the address associated with your account
• Displaying a notice on the Marketplace Services
Your continued use of the Marketplace Services after changes become effective
constitutes acceptance of the modified Terms.
12.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the
remaining provisions will remain in full force and effect.
12.4 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver
of that provision or any other provision.
12.5 Assignment
You may not assign or transfer these Terms or your account without our prior
written consent. We may assign these Terms without restriction.
