RELIABLE RESIDENCE — TERMS OF SERVICE FOR HOSTS
These Terms of Service ("Terms") constitute a legally binding agreement between the undersigned Host ("Host," "Owner," or "you") and Reliable Residence Inc., a Wisconsin corporation ("Reliable Residence," "Marketplace," "we," "our," or "us"), governing your use of our platform and related services ("Marketplace Services") to list and rent furnished monthly rental properties to healthcare professionals and other qualified renters ("Renters").
1ABOUT RELIABLE RESIDENCE
1.1Marketplace Services Overview
Reliable Residence operates an online marketplace connecting property owners with healthcare professionals and other renters seeking furnished monthly housing. We are a marketplace platform. We are not a property manager, landlord, real estate broker, or party to any rental agreement between Hosts and Renters.
1.2What We Provide
- A platform for Hosts to list furnished properties
- Optional Renter screening services performed on behalf of Hosts
- Payment processing and rent collection through Stripe
- A standard Booking Agreement used for every booking
- Booking coordination and customer support
1.3What We Do Not Provide
- Property management, maintenance, lawn care, snow removal, or repairs
- Any role as a party to the rental agreement between Host and Renter
- Legal review of your lease, addenda, or house rules
- Verification that your lease or screening practices comply with applicable law
- Any guarantee of bookings, occupancy, or income
- Insurance coverage of any kind
2ELIGIBILITY & ACCOUNT CREATION
2.1Eligibility Requirements
To list properties, you must:
- Be at least 18 years of age
- Have legal authority to rent the property (as owner or authorized agent)
- Have legal capacity to enter binding contracts
- Provide accurate and complete information
- Not be prohibited from using the Marketplace Services under applicable law
- Comply with all applicable federal, state, county, and municipal laws, including landlord-tenant law, fair housing law, tenant screening law, zoning and rental licensing requirements, and tax obligations
2.2Account Registration
You agree to provide truthful and complete registration information, keep it current, keep your credentials confidential, notify us immediately of unauthorized account use, and accept responsibility for all activity under your account.
2.3Account Suspension or Termination
We may suspend or terminate your account at any time for:
- Violation of these Terms, including Section 7(Platform Integrity & Off-Platform Conduct)
- Fraudulent or deceptive conduct
- Listings that violate our standards or policies
- Failure to pass or maintain property verification
- Substantiated Renter complaints
- Non-compliance with applicable law
- Any conduct we reasonably determine harms or could harm Reliable Residence, Renters, or other users
Termination does not extinguish amounts you owe us, including amounts owed under Section 7.6.
3PROPERTY LISTING REQUIREMENTS
3.1Minimum Property Standards
Required:
- Fully furnished, including all furniture necessary for comfortable living
- Linens and towels included
- All utilities included in rent (electric, gas, water, sewer, trash)
- WiFi internet included in rent
- Passes in-person walkthrough and verification by Reliable Residence
You may not bill utilities or internet to a Renter separately, as a recurring surcharge, or as an overage charge above a usage cap. The Renter's monthly cost must be the rent and any recurring fees disclosed before booking.
Prohibited:
- Properties that do not meet applicable health and safety codes
- Properties with active code violations
- Properties in violation of HOA rules, condominium bylaws, or superior lease restrictions
- Properties used for illegal purposes
3.2Property Verification & Walkthrough
Before your property can accept bookings, you must complete your listing with accurate information and photos, and a Reliable Residence representative will conduct an in-person walkthrough to verify that the property meets our minimum standards.
You acknowledge that approval is at our sole discretion; that we may decline any property for any lawful reason, including subjective factors such as cleanliness, condition, location, or marketability; that approval is not a guarantee, warranty, or representation about the property's condition, habitability, or legal compliance; and that we may suspend or remove a listing at any time if standards are not maintained.
3.3Accurate Listing Information
You represent and warrant that all listing information is accurate, complete, and not misleading; that photos reflect the property's current condition; that you have disclosed all known material defects; that you have legal authority to rent the property; and that the property complies with applicable law.
3.4Listing Maintenance
You agree to keep listing information current, maintain an accurate availability calendar, promptly notify us of material changes to the property, and update photos when the property's condition changes.
4BOOKING TYPES & RENTER SCREENING
4.1Booking Type Selection
You will select one of two booking types for each listing:
Instant Book. Renters may book without your prior approval. Bookings are confirmed automatically, subject to the Renter passing screening.
Request to Book. Renters submit a request for your review. You have 24 hours to approve or decline. If you do not respond within 24 hours, the request expires, the Renter's authorization hold is released, and no booking is formed.
4.2Screening Options
You will select one of two screening approaches for each listing.
Option A — Reliable Residence Screens. We conduct screening on your behalf through our third-party consumer reporting agency. Screening may include:
- Consumer credit report
- Criminal background check
- Eviction history search
- Judgment and lien search
- Sex offender registry check
The components we run, and the criteria we apply, vary by jurisdiction. Certain checks are restricted or prohibited in some cities, counties, and states, and we will omit or limit components where required by applicable law. Option A may not be available in every market. You receive an approved or denied outcome only, not the underlying consumer report. There is no charge to you.
Criteria. The criteria we apply are set out in the Reliable Residence Tenant Screening Criteria Policy, which is incorporated into these Terms by reference and is provided to each applicant in writing before any screening fee is charged. You may request a copy at any time. The criteria applied depend on the location of your property, and we do not apply categories that applicable law restricts or prohibits in that jurisdiction.
Validity. A Renter's screening approval is valid for 12 months from the date the Renter passed screening. The validity period applies only to a passed screening; a denied applicant must submit a new application and pass screening before any approval takes effect.
Adverse action. Where we make the screening decision, we issue both the pre-adverse action notice and the adverse action notice required by the Fair Credit Reporting Act, including delivery of the consumer report and the Consumer Financial Protection Bureau summary of rights, and a period for the applicant to dispute inaccurate information before the decision is final.
Option B — You Screen. You conduct screening using your own criteria and processes, and you must complete screening within 24 hours of receiving a booking request.
If you select Option B, you are solely responsible for:
- Knowing and complying with all federal, state, county, and municipal laws governing tenant screening in the property's jurisdiction, including fair housing law, the Fair Credit Reporting Act, fair chance and criminal record ordinances, source-of-income protections, and any limits on the use of credit history or eviction records
- Obtaining all required applicant consents and disclosures
- Issuing both the pre-adverse action notice and the adverse action notice required by the Fair Credit Reporting Act whenever a denial is based in whole or in part on a consumer report. The pre-adverse action notice must include a copy of the consumer report relied on and a copy of the Consumer Financial Protection Bureau document A Summary of Your Rights Under the Fair Credit Reporting Act, and must be sent far enough before the decision to give the applicant a reasonable opportunity to dispute inaccurate information. The adverse action notice must identify the consumer reporting agency by name, address, and telephone number, state that the agency did not make the decision and cannot explain it, and describe the applicant's right to dispute the information and to obtain a free copy of the report within 60 days
- Applying your criteria consistently to all applicants
- Retaining records documenting your screening decisions
- Setting, collecting, and refunding any application or screening fee you charge. Any such fee is collected by you directly from the applicant outside the Reliable Residence platform. We do not process, hold, set, or take any portion of it. You are responsible for complying with applicable law governing application and screening fees, including fee caps, actual-cost limits, written disclosure requirements, and refund obligations in your property's jurisdiction
The Reliable Residence Tenant Screening Criteria Policy does not apply to listings you screen yourself. Reliable Residence does not review, approve, or validate your screening criteria and assumes no responsibility for your compliance.
4.3Fair Housing Compliance
Regardless of screening option, you agree to comply with all federal, state, and local fair housing laws; not to discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, or any other protected characteristic under applicable law; to apply criteria consistently; and to maintain records of your screening decisions.
5BOOKINGS & RENTAL AGREEMENTS
5.1Minimum Stay
All bookings must be for a minimum of 30 consecutive nights. Where applicable law in the property's jurisdiction defines a short-term or transient rental by reference to a calendar month rather than a fixed number of nights, bookings must meet that longer threshold. We do not facilitate short-term vacation rentals.
5.2The Reliable Residence Booking Agreement
Every booking requires agreement to the standard Reliable Residence Booking Agreement, which both you and the Renter accept during the booking flow. The Booking Agreement covers the rental period, total rent and payment schedule, your property rules, your cancellation and refund policy, and the parties' basic obligations.
The Booking Agreement is a direct contract between you and the Renter. Reliable Residence is not a party to it.
5.3Your Supplemental Lease
You may layer your own lease, addenda, or house rules on top of the Booking Agreement. If you do:
- You are solely responsible for the content, legality, and enforceability of those documents
- We do not review your lease and are not responsible for whether it complies with federal, state, county, or municipal law, including landlord-tenant statutes, rental practice regulations, security deposit rules, prohibited lease provision rules, or local rental ordinances
- Your supplemental terms may not conflict with Section 6 (Payment Terms) or Section 7 (Platform Integrity & Off-Platform Conduct). In the event of a conflict with those sections, these Terms control, and the conflicting provision of your lease is void as between you and Reliable Residence
- Your supplemental terms must be disclosed to the Renter before booking confirmation
5.4Your Responsibilities as Landlord
You are solely responsible for property condition, safety, and habitability; compliance with all applicable landlord-tenant law; maintenance and repairs during the rental period; security deposits, if collected; lease enforcement; eviction proceedings, if necessary; property and liability insurance; and all property-related taxes and fees.
5.5Fees You Set
You alone determine, and are solely responsible for the amount and legality of:
- Base monthly rent
- Security deposits
- Cleaning fees
- Pet fees and pet deposits
- Parking fees
- Any other recurring or one-time fees you charge
Reliable Residence does not set, cap, negotiate, or validate these amounts. You are responsible for ensuring each fee and deposit complies with applicable law, including any statutory limits on security deposit amounts, holding requirements, itemization, interest, and refund timelines.
5.6Property Access & Check-In
Check-in and check-out instructions are your responsibility. You are responsible for providing the Renter with access to the property on the check-in date; ensuring the property is clean and ready for occupancy; providing all keys, codes, and access instructions; and being available, or designating a representative, for check-in coordination. Reliable Residence does not manage, hold, or distribute access credentials.
6PAYMENT TERMS
6.1Payment Processing
All payments are processed through Stripe. You agree to create and maintain a valid Stripe account, accept Stripe's Terms of Service and Privacy Policy, and provide accurate banking information for payouts.
6.2Service Fee
Reliable Residence charges Hosts a service fee of 3% of Covered Amounts. Renters separately pay a service fee of 5% of Covered Amounts.
"Covered Amounts" means:
- Base monthly rent, plus
- Any recurring monthly fees you charge (for example, monthly parking or monthly pet rent), other than charges prohibited by Section 3.1
Covered Amounts do NOT include:
- Security deposits or any other refundable deposit
- One-time, up-front fees, including cleaning fees, pet fees, pet deposits, move-in fees, and administrative fees
No service fee is assessed on deposits or one-time up-front charges. The Host service fee is deducted from your payout before transfer.
6.3Payout Schedule Options
You will select one of two payout schedules:
Lease-Aligned Rent. The rent period runs from a specific day of the month to the day before that same day the following month (for example, the 14th to the 13th). The first period runs from the booking start date. The final period is prorated if the booking ends before the scheduled period end.
Example — booking from June 14 to September 10: June 14–July 13 (full), July 14–August 13 (full), August 14–September 13 (full, prorated to reflect the September 10 end date, deducting 3 days).
Calendar-Aligned Rent. Rent runs from the 1st of the month through month end. The first and last months are prorated.
Example — booking from June 14 to September 10: June 14–30 (prorated), July 1–31 (full), August 1–31 (full), September 1–10 (prorated).
6.4Payout Timing
Funds are transferred to your Stripe account according to your selected schedule. Stripe then transfers to your bank account per your Stripe payout settings, typically 2–5 business days.
7PLATFORM INTEGRITY & OFF-PLATFORM CONDUCT
7.1Rent Must Be Collected Through the Platform
For every booking that originates on the Marketplace Services, you must collect all rent and all recurring fees through Reliable Residence. You may not request, accept, or arrange payment of rent or recurring fees by cash, check, Venmo, Zelle, ACH, direct transfer, or any other method outside the platform.
This obligation applies to current, future, and repeat bookings, including extensions and renewals of a reservation. It is not limited to a fixed period of time.
Exception. Off-platform collection is permitted only where Reliable Residence has given prior written authorization, agreed in writing (including by email) by an authorized Reliable Residence representative and specific to the booking or listing in question. Verbal statements do not constitute authorization.
7.2Prohibited Conduct
You may not:
- Move, or ask or encourage a Renter to move, current, future, or repeat bookings off the platform, including extensions and renewals of a reservation
- Ask or encourage a Renter to book, pay, or contract directly with you or through another platform
- Offer discounts, rate reductions, or other incentives conditioned on booking or paying off the platform
- Cancel a confirmed booking in order to rebook the same Renter off the platform
- Share direct contact information, including phone numbers, email addresses, social media handles, or external links, in listing text, listing photos, or messages before a booking is confirmed
- Include links, photos, or hashtags in your listing or messages that direct users off the platform, including images that contain a web address, QR code, or social media handle
- Collect rent, recurring fees, or security deposits outside the platform. An application or screening fee charged under Option B of Section 4.2 is the exception and is collected by you directly
- Require a Renter to register on an external website or install a third-party application in order to book or access your property
- Use Renter contact information obtained through the platform for marketing, mailing lists, or soliciting direct bookings
7.3What Is Permitted
Nothing in this Section prevents you from:
- Communicating with a Renter through platform messaging at any time, including after a stay has ended
- Using an alternative means of communication after a booking is confirmed, where the Renter requests it
- Requesting additional contact or identity information where required for legal or compliance reasons, provided you disclose the requirement and the reason in your listing
- Operating your own website, newsletter, or social media presence that Renters may choose to follow on their own initiative
7.4How We Assess Violations
Active or repeated solicitation is what we act on. Intent and frequency matter.
A Renter who unilaterally proposes an off-platform arrangement, without encouragement from you, is not itself a violation by you. Agreeing to that arrangement, or acting on it, is.
An isolated message is assessed differently from a pattern of steering Renters off the platform. We consider whether the conduct was repeated, whether it was initiated by you, and whether payment was actually moved off the platform.
7.5Enforcement
Enforcement scales with the conduct:
- Isolated or first-time conduct: a warning identifying the specific conduct and what to correct
- A pattern of active solicitation: reduced search placement, listing suspension, or removal of the listing
- Repeated violations after a warning, or conduct involving fraud or misrepresentation, including collecting a deposit off the platform and then failing to honor the booking, or systematically harvesting Renter contact details: permanent account deactivation and removal of all listings
Except in cases involving fraud, misrepresentation, or immediate risk to a Renter, we will normally issue a warning before suspending a listing or account.
7.6Fee Remedy for Off-Platform Payment
Separately from the enforcement steps in Section 7.5, if rent or recurring fees for a booking, extension, renewal, or repeat booking subject to this Section are paid outside the platform without prior written authorization, Reliable Residence may invoice you for 8% of the total amounts paid off-platform, representing the combined Host (3%) and Renter (5%) service fees we would otherwise have earned.
Invoices under this Section are due within 15 days. We may offset unpaid amounts against any current or future payouts owed to you. This Section survives termination of these Terms and closure of your account.
7.7Off-Platform Communication
Communication that occurs off the platform is not monitored or recorded by us, is not covered by our support or dispute-facilitation services, and does not relieve you of any obligation in this Section.
8CANCELLATIONS, REFUNDS & EARLY TERMINATION
8.1No Platform-Wide Policy
Reliable Residence does not set a cancellation policy, refund policy, or early termination policy. These are determined entirely by you and disclosed in your listing and Booking Agreement.
8.2Your Obligations
You are solely responsible for:
- Setting a cancellation, refund, and early termination policy and disclosing it clearly before booking
- Processing refunds according to your stated policy and applicable law
- Complying with state and local landlord-tenant law regarding lease termination, notice, mitigation of damages, and refunds
- Handling all cancellation and early termination disputes directly with the Renter
8.3Our Role
Reliable Residence is not a party to cancellation, refund, or early termination determinations and does not mediate these disputes. We will process refunds you authorize through the platform.
8.4Service Fees on Cancelled Bookings
Reliable Residence service fees are non-refundable.
8.5Host Cancellations
Cancelling a confirmed booking causes significant harm to Renters, who are frequently relocating for a fixed-date work assignment. Repeated or unjustified Host-initiated cancellations may result in reduced search placement, listing suspension, or account termination.
9HOST RESPONSIBILITIES & OBLIGATIONS
9.1Property Maintenance
You agree to maintain the property in safe, habitable condition throughout every rental period; make necessary repairs promptly; respond to Renter maintenance requests within 24 hours; comply with applicable building, health, and safety codes; and maintain working smoke detectors, carbon monoxide detectors, and other required safety equipment.
9.2Legal Compliance
You agree to comply with all applicable federal, state, county, and municipal law, including landlord-tenant law, fair housing law, tenant screening law, zoning and rental licensing regulations, building and safety codes, HOA and condominium rules, superior lease restrictions, and all tax obligations.
9.3Insurance
You are solely responsible for maintaining adequate property, hazard, and liability insurance, and any additional coverage required by your lender or HOA. Reliable Residence provides no insurance coverage of any kind. You should confirm with your insurer that your policy covers rental use of the property.
9.4Taxes
You are solely responsible for reporting rental income, paying applicable income taxes, and collecting and remitting any occupancy, sales, or other taxes required in your jurisdiction. We do not withhold taxes from your payouts. You may receive a Form 1099-K from Stripe if your annual payment volume exceeds the applicable IRS reporting threshold.
9.5Renters Insurance
You may require Renters to carry renters insurance as a condition of booking. If you do, you must state the requirement, the minimum coverage amount, and any requirement to name you as an interested party in your listing and Booking Agreement before the booking is confirmed.
You are responsible for verifying compliance with any insurance requirement you impose. Reliable Residence does not collect, verify, or track certificates of insurance.
9.6Communication
You agree to respond to Renter inquiries within 24 hours, respond to Reliable Residence communications promptly, maintain professional and respectful communication, and provide accurate information to Renters and to us.
10LISTING REMOVAL & SUSPENSION
10.1Our Right to Remove Listings
We may remove, suspend, or delist your property at any time for violation of these Terms; failure to maintain property standards; substantiated Renter complaints regarding condition, safety, or cleanliness; non-compliance with applicable law; false or misleading listing information; failure to respond to Renters or to us; violation of Section 7; or any conduct we reasonably determine harms or could harm Renters, Reliable Residence, or our reputation.
10.2Notice
We will attempt to provide notice before removing a listing, except where there are immediate safety concerns, legal violations, fraudulent conduct, or other urgent circumstances.
10.3Effect on Existing Bookings
Removal of a listing does not automatically cancel confirmed bookings. You remain obligated to honor confirmed bookings and to collect payment through the platform under Section 7 unless we notify you otherwise in writing.
Any booking request pending at the time of removal, suspension, or account closure must be accepted or declined within the 24-hour period stated in Section 4.1. A request left unresolved expires, and the Renter's authorization hold is released.
These obligations apply whether the listing was removed by us or withdrawn by you.
10.4Reinstatement
You may request reinstatement by correcting the issue, providing documentation of corrective action, and submitting a request to contact@reliableresidence.com. Reinstatement is at our sole discretion and is not guaranteed.
11OPTIONAL FEATURES
11.1Calendar Synchronization
You may optionally sync your Reliable Residence calendar with other platforms to reduce double-bookings. Calendar sync is optional, is your responsibility to configure and maintain, is not guaranteed to be error-free or real-time, and is not a substitute for actively managing your calendar. You remain responsible for avoiding double-bookings and honoring all confirmed reservations.
11.2Additional Services
We may from time to time offer optional services such as professional photography, listing optimization, or enhanced visibility. These will carry separate terms and pricing.
12PRIVACY & DATA USAGE
12.1Data Sharing
We may share your information with Renters (for booking purposes), Stripe (for payment processing), our screening provider, service providers supporting platform operations, and law enforcement or government agencies where required by law.
12.2Data Retention
- Account information: until account closure, plus 7 years for legal compliance
- Booking information: 7 years after booking completion, for legal and tax purposes
- Payment information: per Stripe's retention policies

12.3Consumer Report Information
Under Option A we do not provide you with an applicant's consumer report. You receive the approved or denied outcome only.
Under Option B you obtain consumer reports directly and are solely responsible for handling them lawfully, including limiting internal access, keeping them confidential, not redistributing them except as adverse action obligations or applicable law require, and disposing of them using reasonable measures to protect against unauthorized access or use. These obligations survive closure of your account.
13LIMITATION OF LIABILITY
13.1Services Provided "As Is"
THE MARKETPLACE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13.2No Guarantee of Bookings
RELIABLE RESIDENCE DOES NOT GUARANTEE ANY NUMBER OF BOOKINGS OR OCCUPANCY RATE, THAT RENTERS WILL HONOR THEIR BOOKINGS, ANY PARTICULAR INCOME, THE CONDUCT OR IDENTITY OF RENTERS, OR THAT THE MARKETPLACE SERVICES WILL MEET YOUR EXPECTATIONS.
13.3Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RELIABLE RESIDENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OR USE; PROPERTY DAMAGE CAUSED BY RENTERS; PERSONAL INJURY OCCURRING AT YOUR PROPERTY; DISPUTES BETWEEN HOSTS AND RENTERS; ACTS OR OMISSIONS OF RENTERS OR OTHER THIRD PARTIES; OR TAX LIABILITIES ARISING FROM YOUR RENTAL INCOME.
IN NO EVENT SHALL RELIABLE RESIDENCE'S TOTAL LIABILITY TO YOU EXCEED THE TOTAL SERVICE FEES YOU PAID TO RELIABLE RESIDENCE IN THE 12 MONTHS PRECEDING THE CLAIM.
13.4Indemnification
You agree to indemnify, defend, and hold harmless Reliable Residence and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Marketplace Services; your violation of these Terms; your violation of any third party's rights; your violation of applicable law; the condition of your property or injuries occurring there; your screening practices and decisions; the content or legality of your lease or supplemental terms; your relationship with Renters; and your failure to meet tax obligations.
14DISPUTE RESOLUTION
14.1Informal Resolution
Before filing any formal claim, you agree to contact us at contact@reliableresidence.com to attempt informal resolution. We will attempt to resolve the dispute within 30 days.
14.2Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles.
14.3Venue
Any legal action arising from these Terms must be brought in the state or federal courts located in Wisconsin, and you consent to exclusive jurisdiction and venue in those courts.
14.4Arbitration Agreement
Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Marketplace Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.
ARBITRATION MEANS YOU WAIVE YOUR RIGHT TO A JURY TRIAL.
Arbitration will be conducted in Wisconsin unless the parties agree otherwise. Each party bears its own costs of arbitration.
14.5Class Action Waiver
YOU AND RELIABLE RESIDENCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
14.6Exceptions to Arbitration
Either party may bring a qualifying claim in small claims court. Either party may seek injunctive relief in court to prevent actual or threatened infringement of intellectual property rights. Reliable Residence may bring an action in court to collect amounts owed under Section 7.6.
14.7Opting Out of Arbitration
You may opt out of the arbitration agreement in Section 14.4 and the class action waiver in Section 14.5 by sending written notice to contact@reliableresidence.com within 30 days of the date you first accept these Terms. If you held an account before these Terms took effect, the 30-day period runs from the date we notify you that these Terms have taken effect.
Your notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Notice sent by another method, or after the 30-day period has closed, is not effective.
Opting out affects only the arbitration agreement and the class action waiver. All other provisions of these Terms continue to apply. Opting out will not affect your account, your standing with Reliable Residence, or your ability to use the Marketplace Services.
15GENERAL PROVISIONS
15.1Entire Agreement
These Terms, together with the Booking Agreement and our Privacy Policy, constitute the entire agreement between you and Reliable Residence regarding the Marketplace Services.
15.2Modifications to Terms
We may modify these Terms at any time. We will notify you of material changes by posting updated Terms on the platform, sending an email to the address associated with your account, and displaying a notice on the platform. Your continued use after the effective date of a change constitutes acceptance.
15.3Electronic Communications and Notices
You consent to receive communications from us electronically, including by email to the address associated with your account, by SMS where you have opted in, and by notices posted within the platform. You confirm that you are able to access and retain electronic communications in the formats we provide. Electronic communications satisfy any legal requirement that a communication be in writing.
We may deliver notices about your account, bookings, payments, screening outcomes and any adverse action notices, and changes to these Terms by these means. You are responsible for keeping your email address and other contact information current and for maintaining an account capable of receiving our messages. A notice sent to the email address associated with your account is treated as received on the date sent, unless we receive notification that delivery failed.
You may withdraw your consent to electronic communications by contacting contact@reliableresidence.com. Because we deliver required notices electronically, withdrawing consent may require us to suspend or close your account.
Notices to Reliable Residence must be sent to contact@reliableresidence.com or to our address of record and are effective when received.
15.4Account Closure and Data Deletion
You may close your account at any time by contacting contact@reliableresidence.com. Closing your account does not cancel a confirmed booking. You remain responsible for honoring confirmed bookings and for any obligation that accrued before closure, including amounts owed under Section 7.6. Pending booking requests are handled as described in Section 10.3.
You may request deletion of your personal information as described in our Privacy Policy. We may retain information where retention is required or permitted for legal, tax, accounting, fraud prevention, or dispute resolution purposes, including for the periods stated in Section 12.2. Retained information remains subject to our Privacy Policy.
15.5Force Majeure
Neither party is liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disaster, fire, flood, severe weather, epidemic or public health emergency, war, terrorism, civil unrest, labor disruption, utility or telecommunications failure, failure of a third-party service provider, or government action or order. This Section does not excuse any obligation to pay amounts already due.
A booking affected by such an event remains subject to the Host's cancellation and refund policy.
15.6Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
15.7Waiver
Our failure to enforce any provision does not waive that or any other provision.
15.8Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
15.9Independent Contractor
You are an independent business owner. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and Reliable Residence.
15.10Survival
Sections 7.6 (Fee Remedy for Off-Platform Payment), 13 (Limitation of Liability), 14 (Dispute Resolution), and any accrued payment obligations survive termination of these Terms.
